In 2023, let’s do this! Let’s pass the Minnesota Equal Rights Amendment Bill in this legislative session and ratify it in the 2024 election. Equal rights can be protected as a Minnesota constitutional right by the end of 2024.



The 2023 MINNESOTA STATE EQUAL RIGHTS AMENDMENT BILL:

Equality under the law shall not be abridged or denied by this state or any of its cities, counties, or other political subdivisions on account of race, color, creed, sex, sexual orientation, gender identity or expression, age, disability, ancestry, or national origin.


How can it become an amendment to the Minnesota Constitution?

A bill introducing the amendment must pass through the state legislature, then be ratified by a majority of voters in a statewide election.


The chief authors of the 2023 state equal rights amendment are Senator Mary Kunesh and Representative Kaohly Herr. Their goal, and ours, is to have the legislation passed through the state legislature in the 2023-2024 session, so that it could be on the ballot for the 2024 election. If a majority of voters vote "Yes" to ratify the amendment, it takes effect immediately.


But wait, isn't there a federal equal rights law?


True. It reads, “Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.” However, it still is not an official amendment to the Constitution. While all of the constitutional requirements have been satisfied, there are technicalities and various legal arguments which have served as road blocks to final publication.


Therefore, Senators Sandy Pappas and Representative Kristin Bahner have authored the 2023 MINNESOTA FEDERAL ERA RESOLUTION TO CONGRESS: BE IT RESOLVED by the Legislature of the State of Minnesota that it urges the Congress of the United States to pass House Resolution 891, resolving that the requirements have been met to ratify the ERA and that it shall now be known as the Twenty-Eighth Amendment to the Constitution.


What can we do?

We can let our representatives in the Minnesota Legislature know that this is important to us! Send your letter today to the MN Speaker & Majority Leader to let them know we need the State ERA passed in 2023! 100 years is to long to wait!
